In Culpeper, Virginia, clearing your own ground needs no tree permit. Neither the town nor the county asks for one on private land. Three other questions matter: how much ground gets disturbed, whether any of it is sensitive, and where the wood goes.

The town (§ 7-4, § 7-5) and the county (Chapter 8) both require an erosion-and-sediment-control plan and a land-disturbing permit at 10,000 square feet or more of clearing, grading or grubbing. Below that, and for home landscaping or bona fide farm clearing, no permit applies.

The catch is the county's sensitive-area rule (§ 8-1). In a floodplain, on a 15 percent or steeper slope, in a wetland, or in the Mountain Run Lake and Lake Pelham watershed west of town, a plan is needed at any size. Civil penalties reach $10,000. We check your lot before we quote.

A forestry mulcher beats hand work through cedar and leaves a cleaner grade. The chipper and grapple take a three-foot sycamore trunk or a walnut log worth saving. Trees you keep get backyard-removal care.

We Know the Debris Rules

In town, fires need the town manager's permit (§ 8-3), pickup stops at 50-pound bundles and 4-inch limbs (§ 20-34, § 20-35), and county sites take no brush (§ 11-27). So in town we plan on chipping and hauling.

Burning Outside Town

From February 15 to April 30, Virginia's 4 PM Burning Law bans open fires before 4 p.m. within 300 feet of woods, brush or dry grass. Whoever lets a fire escape pays to put it out.

The Cleared Lot Stays Clean

Cedar and honeysuckle come back fast. In town, grass over 12 inches is unsightly under Chapter 20, and after 15 days' notice the town mows and bills you. We plan mowing or seeding and can grind stumps so it mows clean.

Do I need a permit for land clearing in Culpeper, VA?

Will you haul the brush off, or mulch it where it falls?

Either. Mulching is usually cheapest; hauling costs more and leaves bare ground. In town those are the only two, since § 8-3 bars unpermitted fires. On county acreage a burn pile can work, within the 4 PM law and any ban. Oak, hickory and walnut can stay as firewood. Nothing gets buried or left in the brush.

How is land clearing priced differently than tree removal?

Removal is priced per tree; clearing by area and density. The debris plan and any permit get their own lines, and under half an acre is priced as one lot.
